Supreme Court on Judge Removal: Key Takeaways from Justice Yashwant Varma's Impeachment Case

In a significant ruling on judicial accountability, the Supreme Court of India has upheld the decision of the Lok Sabha Speaker to constitute an inquiry committee against Yashwant Varma, a sitting judge of the Allahabad High Court. Justice Varma had challenged the legality of the committee formed under the Judges (Inquiry) Act, 1968, arguing that constitutional safeguards for judges were being undermined. The case stems from allegations related to the discovery of burnt cash at his Delhi residence in March 2025.
Dismissing the plea, the Supreme Court observed that “constitutional safeguards for judges cannot come at the cost of paralysing the removal process itself.” The ruling clarifies the balance between judicial independence and accountability.
