After a judge threw out the criminal case against a woman charged in the on-duty traffic death of Phoenix police Officer Paul Rutherford, Maricopa County Attorney stands by decision to bring the case. The criminal case against Nubia Rodriguez was dismissed for a lack of probable cause after a three-day hearing last month. The ruling ended a years-long prosecution in which the court previously found police and prosecutors presented a troubling, false, and biased case to grand jurors to get negligent homicide charges against Rodriguez in the first place.
