We have often seen that when bail is granted to an accused in a case, the police sometimes attempt to re-arrest the accused by introducing new provisions in the same case. Such actions by the police are illegal.
Under Rule 26-21(6) of the Police Rules, 1934, if the court grants bail to an accused and the police wish to re-arrest the accused by introducing new provisions in the case, they must first file an application with the court for the cancellation of bail. Only if the court cancels the bail can the police legally re-arrest the accused.
