Someone recently asked me, "Do grandparents have rights in North Carolina?" The answer is absolutely. Those rights are not absolute and certain procedures have to be followed to establish what those rights might be.
Grandparents are entitled to seek visitation of their grandchildren if there's an ongoing lawsuit. So, for example, if mom and dad are in court suing each other for custody, grandparents can intervene in that case and ask for visitation themselves, but there has to be an ongoing lawsuit.
So, if mom and dad are staying at home and they have, by all outward appearances a good relationship, can grandmom and granddad go in and just sue them because they don't get to see their grandchildren as much as they'd like? The answer is no, they can't. North Carolina respects the sanctity of the marriage and they will not get involved unless there's ongoing litigation.
