Desiring to act as stewards of the ocean: Intergenerational Equity and new High Seas Treaty

The Sargasso Sea, the only known spawning ground for American and European eels, is a unique High Seas maritime ecosystem, which has been recognized as an Ecologically or Biologically Significant Area (EBSA) by the parties to the UN Convention on Biodiversity in 2012. Unfortunately, the previously adopted UN Convention on the Law of the Sea has prevented legal protection of EBSAs located in the area beyond national jurisdiction (aka the High Seas) due to conflicts with its guarantees of freedom of transit, research, and resource extraction in that area. A recently negotiated international treaty aims to reconcile High Seas freedoms with biodiversity protection by invoking principles of intergenerational equity and stewardship. I will discuss the issues driving the adoption of this solution and the new conundrums it generates. What might intergenerational equity regarding biodiversity in the High Seas ecosystems such as the High Seas entail?
